European Health and Digital Executive Agency (HaDEA)

Access to documents

Any EU citizen and any natural or legal person residing or having its registered office in the EU, has a right of access to the documents held by Agency, subject to the conditions defined in Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council and Commission documents (hereafter referred as “the Regulation”) and without prejudice to the measures set up in the Rules of procedure for the application of the Regulation, adopted on 7 September 2021 by the Steering Committee of HaDEA.

Requests for access to documents may be submitted in one of the EU’s official languages and can be sent to the Agency by post or electronically. The application must be made in a sufficiently precise manner and must contain, in particular, sufficient elements to enable the Agency to identify the document requested. The Agency is not required to create a new document, translate a document or gather information in order to reply to an application.

As soon as the Agency receives the application, an acknowledgement of receipt will be sent to the applicant together with a unique registration number assigned to the request. The Agency will respond within a maximum of fifteen (15) working days, unless that period is extended on the conditions set in the Regulation.

For refused or un-responded requests within the period laid down, applicant may submit a confirmatory application to the Agency within fifteen working days.

In case of a total or partial refusal, the Agency will inform the applicant of further remedies, namely court proceedings and/or making a complaint to the European Ombudsman.
